Agreement to Terms

By downloading, installing, or using NicheMAX ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App. NicheMAX is operated by Ascent Technologies ("we," "us," or "our").

Eligibility

By using NicheMAX, you confirm that:

• You are at least 13 years old
• If you are under 18, you have obtained parent or guardian permission
• You agree to these Terms of Service and acknowledge our Privacy Policy

Account

You can create an account using email and password, Sign in with Apple, or Sign in with Google. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account. We may suspend or terminate accounts that violate these Terms.

Subscriptions and Purchases

• NicheMAX Pro subscriptions are available on a weekly and monthly basis
• All payments are processed through Apple's App Store — we do not directly handle payment information
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
• You can cancel anytime in your iPhone Settings > your name > Subscriptions
• No refunds are provided for partial billing periods
• One free rescan is included with your initial analysis; additional rescans are available for $2.99 each as a one-time in-app purchase
• You can restore previous purchases by tapping "Restore Purchases" on the subscription screen

Referral Program

You may share your unique referral code with friends. When 3 friends sign up using your code and reach the paywall, you earn one free week of NicheMAX Pro. You can earn multiple free weeks through additional referrals. We reserve the right to modify or discontinue the referral program at any time. Abuse of the referral system (including creating fake accounts) will result in account termination.

AI Analysis Services

NicheMAX provides AI-powered style analysis using artificial intelligence. You acknowledge that:

• AI analysis results are for entertainment and informational purposes only
• Results are generated by AI and are not guaranteed to be accurate or comprehensive
• We do not provide professional fashion, styling, or personal advice
• Style scores and persona results may vary between analyses
• Your photos are processed by third-party AI services (OpenAI) subject to their usage policies

User Content

By uploading photos or posting content in the App, you grant us a non-exclusive, worldwide license to process, analyze, store, and display that content as necessary to provide the service. You agree not to upload or post:

• Content you do not have the right to share
• Nudity, sexually explicit, or pornographic material
• Violent, threatening, or illegal content
• Content that infringes on intellectual property rights
• Spam, advertisements, or solicitations

Community Guidelines

NicheMAX includes community features such as niche-based group chats and forums. When using these features, you agree to:

• Treat other users with respect
• Not harass, bully, or intimidate other users
• Not post hateful, discriminatory, or offensive content
• Not impersonate other users or public figures
• Not share other users' personal information without consent

We reserve the right to remove content and suspend accounts that violate these guidelines without prior notice.

Intellectual Property

NicheMAX, its design, features, and content (excluding user-generated content) are owned by Ascent Technologies and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Ascent Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amounts you have paid to us in the preceding 12 months.

Termination

You may delete your account at any time through Settings > Privacy & Data > Delete My Account. This permanently removes your account and all associated data. We may terminate or suspend your account at any time if you violate these Terms, engage in fraudulent activity, or abuse the App or its community features.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of NicheMAX after changes constitutes acceptance of the updated terms.
